You may be wondering, 'why would we be doing active shooter training in Northern Michigan?'. Active shooter risk is a very unfortunate reality in America which has led many businesses to prepare their teams for crisis management and response. This is great way to introduce this growing risk to businesses, how they can prepare for it and protection for the response to an active shooter event. </span></p>
<h4>What is an Active Shooter Event?</h4>
<p><a href="https://www.thehartford.com/business-income-insurance" rel="noopener" target="_blank" title="Business Income"></a>U.S. Homeland Security defines an active shooter as "an individual actively engaged in killing or attempting to kill people in a confined and populated area; in most cases, active shooters use firearm(s) and there is no pattern or method to their selection of victims." <li>As a last resort, attempt to take the active shooter down. When the shooter is at close range and you cannot flee, your chance of survival is much greater if you try to incapacitate him or her.</li>

<p>Law enforcement’s purpose is to stop the active shooter as soon as possible. Officers will proceed directly to the area in which the last shots were heard:</p>

<li><strong>Officers may wear regular patrol uniforms or external bulletproof vests, Kevlar helmets and other tactical equipment.</strong></li>
<li><strong>Officers may be armed with rifles, shotguns or handguns.</strong></li>
<li><strong>Officers may use pepper spray or tear gas to control the situation.</strong></li>
<li><strong>Officers may shout commands and may push individuals to the ground for their safety.</strong></li>

<p>The first officers to arrive to the scene will not stop to help injured persons. Instead, expect rescue teams comprised of additional officers and emergency medical personnel to follow the initial officers. These rescue teams will treat and remove any injured persons. They may also call upon able-bodied individuals to assist in removing the wounded from the premises.</p>
<p>Once you have reached a safe location or an assembly point, you will likely be held in that area by law enforcement until the situation is under control and all witnesses have been identified and questioned. Do not leave until law enforcement authorities have instructed you to do so.</p>

Also, employees have been known to contain skimming machines that will copy the credit card data separately before they slide it for the credit card reader. In both of these cases, the vendor will not provide any protection as it wasn’t their systems that failed, it was the business owner's.</li>
<li><strong>Wifi Networks/Internet Systems Exposed: </strong>In this scenario, a hacker is inside the company’s network through WIFI or internet. They can see and duplicate anything happening on your network. So when the business sends data to the reader via internet, they are able to copy that as well. The vendor won’t provide protection as once again it was not their systems that failed, but rather the business.</li>
<li><strong>Cyber Extortion/Business Interruption: </strong> Much like the examples above, hackers are able to get inside the servers and hold the business inoperable. The vendor used for credit card payments is fine and up and running, but your business is unable to accept credit cards or your point of sales systems. The hacker then requests a <span style="text-decoration: underline;">ransom to re-open the systems</span> (<span style="text-decoration: underline;">which the cyber liability insurer will pay</span> if you have a policy in place) and also the insurer will reimburse for the <span style="text-decoration: underline;">amount of revenue they lost</span> during this duration.</li>
<li><strong>Your Credit Card Vendor is Hacked: </strong> The vendor promises PCI compliance, which is a great feature, but most likely does not extend any cyber insurance to you, the business. First, let’s imagine the vendor suffers a major breach. Why is this important?</li>

<li>How much insurance does the vendor carry? Will it be enough to cover ALL of their clients and ALL of those exposed?</li>

<p><strong></strong>As insurance professionals, we're in the business to pay claims. After all, that is why individuals, families and business owners invest money each year - to manage the risks that face them. An insurance policy is called a <em><strong>"conditional contract"</strong></em>. This means that if the insured does <g class="gr_ gr_97 gr-alert gr_gramm gr_inline_cards gr_run_anim Style multiReplace" data-gr-id="97" id="97">X ,</g> the insurer will do Y (protect and indemnify the insured for a covered loss according to the terms of the contract). </p>
<p>So when that time comes that you need to file a claim, what should you do? <strong> FIRST</strong>, make sure no one is injured and the correct authorities and/or emergency response crews are notified. </p>
<p>One suggestion is to<span style="text-decoration: underline;"> act as though you didn't have any insurance</span> at all. This means trying to protect the property from further damage, contacting contractors for estimates, and keeping the process moving so that you can be back to normal sooner..</p>

<p>Most insurance policies require that the <strong>Insured's</strong> <strong><em>Duties After Loss</em></strong> are:</p>

<p>To us insurance nerds this is called "<em>mitigating the loss</em>". This basically means that you're taking the necessary steps to keep the severity of the loss from increasing. It is intended to keep the loss from increasing unnecessarily which will also increase costs to the insurance company and insured. </p>
<p>However, this does not mean that permanent repairs are immediately required. Examples of this would be putting a tarp over a damaged roof to keep <g class="gr_ gr_64 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del" data-gr-id="64" id="64">rain water</g> out, preserving perishable goods by freezing <g class="gr_ gr_72 gr-alert gr_gramm gr_inline_cards gr_run_anim Punctuation only-del replaceWithoutSep" data-gr-id="72" id="72">them,</g> or turn off the water supply to a broken pipe.</p>

<p>It is also your duty to promptly report the loss to the insurance company. Be sure to gather as much information as you can and give your agent a call to provide notice of the claim. Things to include are location, description of what happened, what appears damaged or missing, and details of any expenses you've incurred to prevent further loss.</p>
<p>During this process, you must <strong>cooperate </strong>with the claims investigation. The claims adjuster will ask for copies of invoices, accident reports, financials, etc. They will use this to not only help get the claim paid in a timely manner but to also defend you against any possible liability claim or suit.</p>

<p><span>The changes have been made due to concerns over the protection of sensitive worker information. </span><span>The revocation of these rules has resulted in a lawsuit contending that OSHA did not follow proper notice-and-comment protocol since its formal declaration of reversal came after the deadline to submit these forms on July 1. Many worker advocacy organizations find this change to be negligent. These organizations originally hoped to use OSHA’s data to examine occupational health and safety, analyze the most serious workplace threats, and push for stronger regulatory protections.</span></p>
<p>The electronic recordkeeping rule is still intact for Form 300A, which requires establishments with 250+ employees or those with 20-249 employees in certain high-hazard industries to submit this data electronically. Employers who have not yet submitted their 2017 300A data must do so by Dec. 31, 2018, to avoid penalties and potential audits. In 2018 and beyond, 300A data is due electronically to OSHA by March 2nd. </p>
